• Contract of assignment

    The performer of work (hereinafter referred to as the "Interpreter") and the Client (hereinafter referred to as the "Finnish Interpreting Service") have agreed to provide the Services in accordance with the terms of this Agreement.
    The contractor is not the employer of the contractor, and there is no relationship between the parties. an employment relationship under the Employment Contracts Act.
    This agreement does not constitute an employment relationship. The service provider is self-employed or self-employed with a business identity. He is responsible for his own taxes, pension and social insurance and other legal obligations. Suomen Tulkkauspalvelu Oy does not act as an employer and does not have any rights or benefits as an employee.

    Dismissal: Either party may terminate the agreement by giving two (2) weeks' notice without cause. The termination shall not affect any assignments that have already been expressly agreed and confirmed before the expiry of the notice period.

  • 3. Contractor (Interpreter)

  • These contact details are valid at the time of signing this contract. The interpreter undertakes to maintain his/her contact details through the electronic system of the Finnish Interpreting Service.
  • 4. Content of the mandate

    The Finnish Interpreter Service orders interpretation and/or translation services from Tulki. Interpreting is provided at the premises of the Finnish Interpreting Service's client, at an otherwise agreed location or, in the case of telephone and remote interpreting, at the Interpreter's own premises. The interpreter shall carry out the assignment using his/her own equipment and shall be responsible for the performance of the service The Finnish interpreter shall carry out the assignment independently and shall be responsible for the manner, timing and methods used to carry out the work. The interpreter shall take into account the client's instructions and the general guidelines in the field concerning the quality of the end result, confidentiality and ethical principles of interpreting. The Finnish Interpreting Service is not bound by this contract to commission interpreting services, nor does the Interpreter undertake to provide them. Each order is always made and accepted separately.
    The interpreter works on a case-by-case basis and is not obliged to be available to Suomen Tulkkauspalvelu Oy at all times. The service provider has the right to accept and carry out assignments from other clients as well. This contract does not constitute an exclusive right or limit the Service Provider's right to act for other clients.

    The interpreter is also free to accept and carry out assignments from other clients. The Finnish Interpreting Service does not require the interpreter to work in a specific place, at a specific time or with specific equipment.
  • 5. Fee and payment details

  • In addition to the fees to be charged, the Interpreter may charge the Finnish Interpreting Service for travel expenses using the cheapest possible means of transport, excluding interpreting in the metropolitan area.

    VAT will be added to the prices if the Interpreter is liable for VAT on its business.

    The payment term is 14 days net. Late payment interest rate 7%

    The costs are included in the fee agreed in point 5.

    In order for travel or material expenses to be reimbursed as tax-free reimbursement through the billing service, the costs must be itemised by expense.
  • 6. Cancellation of an order

  • By accepting the order, the Interpreter undertakes to carry out the delivery in the manner and according to the instructions agreed upon when the order is accepted. The service provider is also obliged to inform the customer immediately if he is unable to accept the order offered.

    If the Interpreter cancels the assignment less than three (3) working days before the start of the assignment without an acceptable reason, a compensation of up to 50% of the agreed fee may be charged. The compensation shall be subject to the Client's failure to arrange for a replacement interpreter in due time - however, a minimum charge of one hour.

    The Finnish Interpreting Service has the right to unilaterally and without compensation cancel an order for the next working day on the previous working day by 18:00 at the latest. For cancellations made after this time, the Interpreter has the right to charge the full value of the order.

    If the Interpreter is unable to accept the offered assignment, he/she must notify the Interpreter without delay. The interpreter decides independently which assignments to accept.
  • 7. Code of conduct and professional ethics

  • The interpreter accepts that the Finnish Interpreting Service processes feedback from its clients regarding the interpreting service. The Interpreter agrees that the Finnish Interpreting Service processes the Interpreter's personal data in accordance with the terms of the EU General Data Protection Regulation (GDPR) to the extent necessary to fulfil the obligations of this Agreement and to safeguard the legitimate interests of the Finnish Interpreting Service.

    When carrying out the assignments, the Interpreter undertakes to forward all follow-up orders and enquiries concerning the assignments to the Finnish Interpreting Service.
  • 8. Legal obligations

    This Agreement does not constitute an employment relationship or a direct right of direction between the Finnish Interpreting Service and the Interpreter. The interpreter is responsible for ensuring that it has arranged the insurance and pension cover required for the exercise of its profession and that it has fulfilled its official obligations in connection with its duties.
  • 9. Consent to act as a subcontractor and reporting obligations

    The interpreter agrees that it may be registered as a subcontractor of the Finnish Interpreting Service, for example in public tenders. The interpreter will only provide the Finnish Interpreting Service with relevant information about his/her assignments (e.g. name of the assignment, date, duration) if this is necessary for payment or monitoring purposes. This reporting obligation does not apply to the interpreter's working methods, method-specific solutions or hourly statements, unless otherwise agreed. Negotiation of assignments or contract terms and other similar discussions shall not constitute a basis for invoicing.
  • 10. Terms of payment

  • The fee under this Agreement shall be paid once a month. Payment shall be made by the 10th of the following month.

    The Contractor may send an invoice once a month, no earlier than the 1st of the month. The payment term is 14 days net. The invoice must be made out to the Finnish billing guidelines according to.

    The work and related costs must be invoiced within 6 months of completion. Otherwise, the claim will be considered time-barred.

    This Agreement does not constitute an employment relationship and the procedures set out in the Employment Contracts Act will not apply upon termination. The interpreter shall not be entitled to any compensation payable under the employment contract.
  • 11. Responsibility for the results of the mandate

    The interpreter is directly responsible for the results of his/her assignment. In a situation where a client of the Finnish Interpreting Service makes claims against the Finnish Interpreting Service on the basis of the results of the Interpreter's work, the Finnish Interpreting Service may claim compensation from the Interpreter for the claims arising from the results of the Interpreter's work.
    The Parties confirm that the Interpreter acts independently and at his/her own risk. He/she is not responsible to Suomen Tulkkauspalvelu Oy for the management or supervision of his/her work. The Interpreter shall use his/her own equipment and shall be responsible for all his/her own expenses, unless otherwise agreed in writing.
